High Courts should make judgement in litigant’s understandable language : President Ram Nath

President Ramnath Kovind has emphasized that all the High Courts of the country should make decisions in the same language that the accused can understand. In view of this, he also suggested to set up arrangements for issuing certified copies of the decisions.

Addressing the closing ceremony of the 75th anniversary of the Kerala High Court here on Saturday, said that the poor and exploited people have to suffer the worst of the delayed justice.

In the presence of Supreme Court Chief Justice Deepak Mishra and Union Law Minister Ravi Shankar Prasad, the President said that the High Court’s decisions are written in English, but many languages ​​are spoken in this country. It is not necessary that every plaintiff knows English. In such a situation, he will not be aware of the nuances of the decision and in order to understand the decision, he will depend solely on the lawyer or any other person. It is a waste of time and money.

Delay in getting justice, India’s burning problem

He has suggested arranging translations in local or regional languages ​​to overcome this problem. This work can be done within 24 to 36 hours of the decision. This language can be Malayalam in the Kerala High Court and Hindi in Patna High Court. It is the responsibility of the people of the judiciary and advocates that they should discuss this and take appropriate steps.

The President said that delay in getting justice was a burning problem of the country. This only affects on poor people. That’s why we must find ways to speedily settle the lawsuits. For this, it is necessary to postpone any case only in case of emergency. The adjournment is now upheld for long litigation. He said that the system of judiciary and justice should be stepped up in line with the changes in technology and society.

Speaking on the occasion, Chief Justice Deepak Mishra said that due to delay in getting justice, citizens’ confidence in the judicial process is low. Several committees of the Supreme Court and the High Court are contemplating this issue. There has been great success in this direction. Union Minister Ravi Shankar Prasad said that the judiciary called for settlement of cases pending for more than 10 years.
