SC collegium rejects IB’s objection, says – We will examine the qualifications of the judges

The Supreme Court Collegium has said that only the members of the High Judiciary can judge the professional qualifications of judges who see their work every day, not the Bureau of Intelligence (IB). This comment has been made by the Collegium in its recommendation in which they appointed the three lawyers as a judge in the Jharkhand High Court. The collision between the government and the judiciary can increase on the appointment of judges from this position of the collegium.

The Supreme Court Collegium has recommended the appointment of three lawyers out of the four lawyers’ nominations sent by the High Court for appointment. The Collegium has recommended the appointment of Rajesh Kumar, Anubha Rawat Chaudhary and Kailash Prasad Dev as Judges of Jharkhand High Court. However Pankaj Kumar’s proposal for appointment has been rejected. The Collegium did not find Pankaj Kumar suitable for the post of Judge.

The Collegium, chaired by Chief Justice Deepak Mishra, says that the High Judiciary is only capable of assessing and judging the professional qualifications of judges. The Collegium has said that the Jharkhand High Court had recommended to appoint four lawyers to be a High Court judge on September 4, 2016. On the recommendation of the High Court Collegium, the state’s Chief Minister and the Governor also agreed. The Collegium has given detailed information about opinion counseling from the IB report and its respective associate judges about each lawyer being appointed as a judge of the High Court.

On the proposal of Advocate Pankaj Kumar, the Collegium says that considering the contents of the record, the standard of his income and his relations with various organizations, he was not found suitable for the post of Justice. The collegium rejected the proposal for the appointment of Pankaj Kumar. Regarding Rajesh Kumar, the Collegium says that his income and age were found according to the standards. On the comments of IB about Rajesh Kumar’s professional qualifications, the Collegium has said that members of the High Judiciary can better assess their abilities.

Apart from this, the Collegium has recommended appointment of lawyer Arindam Lodh as Judge of the Tripura High Court. Judge J Chelameswar and Judge Ranjan Gogoi were also present in the Collegium Approving Appointments.
