If ICICI Bank has blocked your current account holding a balance of approximately ₹25 lakhs without assigning any lawful reason, and is now refusing to compensate you for the consequential losses, you have the following remedies available under law: 1. Complaint before RBI Ombudsman: You may file a detailed complaint before the RBI Integrated Ombudsman for deficiency in banking service, arbitrary freezing of account, and failure to provide reasons or timelines for resolution. 2. Civil Action for Damages: You can initiate legal proceedings against the bank for recovery of damages arising out of business loss, reputational harm, and mental harassment caused due to unlawful blocking of funds. 3. Arbitration (if applicable): Please carefully examine the account opening documents and terms & conditions to check whether they contain an arbitration clause. If so, the dispute would need to be referred to arbitration in accordance with the agreement. 4. Check for Cyber Fraud or Law Enforcement Flagging: It is also important to verify whether: a) Any cyber fraud complaint, b) Law enforcement request, or c) Regulatory flag, is pending against the account. Banks often act on third-party instructions but are still legally bound to inform the account holder of the basis for such action. If the bank has failed to communicate reasons, provide documents, or act within a reasonable timeframe, such conduct is legally untenable and actionable. You may proceed simultaneously with regulatory remedies and legal action to protect your rights and recover damages. Warm Regards, Advocate Prakhar Gupta Advocate in Kota
