Dear Sir, It is not clear whether Will to be cancelled during lifetime of the bequeather or after his death. It is valid during entire life of bequeather unless he executes another Will. After his death a probate has to be filed otherwise its validity will weaken after 3 years. Please mark “LIKE” if satisfied by my answer.
A Will becomes enforceable only after the death of the testator. It gives absolutely no rights to the legatee (the person who inherits) until the death of the testator . It has no effect during the lifetime of the testator. A testator can change his Will, at any time, in any manner he deems fit. will cannot be cancel even if not brought to the knowledge of siblings or anyone else.. You can file an application in Civil Court for cancellation of will on certsin grounds available you can seek injuction/stay from the court ....
Will once executed is valid forever unless it is revoked or changed or cancelled the Executant himself. No time factor will make the Will invalid. No Will can be cancelled even if not brought to the knowledge of siblings or anyone else. You can file a Civil Suit for cancellation of Will on certain grounds available. Anyone who is effected adversely by Execution of Will can seek Injunction from the Court. Will is valid till the Will executor make a New Will . Under Hindu Law a person can make any number of Will till he/ she dies. If the Will is Registered it will have more Value.
