    File a Security Application before the Debt Recovery Tribunal Jabalpur under the SARFESI ACT asking for the possession orders from the bank filling all the details .As u r the legal auction purchaser the bank cannot deny possession unless any interim protection is obtained by the borrower .Contqct me for any help

    Once full payment is made in an auction sale under SARFAESI, the bank is legally bound to hand over physical possession and relevant documents. Refusal to give possession or inventory details is not justified. You can take the following steps: 1. Send a legal notice to the bank demanding immediate possession 2. File an application before the DRT under SARFAESI Act for possession and directions 3. Seek police assistance through DRT for execution of possession Non-cooperation by bank after receiving full amount can also amount to deficiency and can be challenged legally.
