    Dear Sir, You must take appropriate defence for your mother or directly go to the High Court and get quash such cheque bounce case saying that the said cheques were misused by her husband. Please mark “LIKE” if satisfied by my answer.

    No doubt that dead person cannot be prosecured but since the Cheques being issued on behalf living person does have the accountability. Thus, Cheques issued on behalf of your mother needs to be taken xx care of cautiously and to be contested tooth and nail.     If the accused person in a cheque bouncing case dies, the case gets over and the only remedy left with the complainant is to file a civil case against the legal heirs of the accused person (if it is in limitation) because criminal liability cannot be shifted to the legal heirs of the accused person Reply to the legal notice through Advocate....
