Dear Mam, Section 25 of the Guardians and Wards Act,1890 deals with the title of guardian to custody of ward. Child below age of five years has to reside ordinarily with mother. Tender age of the child below five years would necessarily require natural love and affection.(Sarabji vs Shri Piara Lal, AIR 2005,Punjab and Haryana 237.
