we bought a property of 69 cents and a 8ft road was given to the property as easement. Road ownership is with owner. Now he is constructing a commercial building on his property just near to the road. He is not maintaining any distance from the road 1.5 m according to the panchayat building rule. He is saying that he is the owner of the property and you are only having easement rights so no need to keep any distance from the road. This road is only used by the owner and us. Does this legally support him.

Lodge complaint with Municipality/panchayat authority or approach the Civil Court.

This is my response to you: 1. Send him a legal notice; 2. Make a formal complaint to the panchayat; 3. If he still does not listen then approach the district collector; 4. The last method is to approach civil court and file a suit 5. Once you file suit then seek injunction orders.

Sir... first u have give a complaint to panchayath, they will Measure the land...if they fail to do...u can appeal this matter to PDO ( Public Development Officer)... or contact me...
