    I can understand but receiving of summon means that the court acknowledges that you are aware of the divorce case. Now if you do not appear or do not file the WS, then the court shall proceed ex parte against you. If you have not received the summon then it would have been a different scenario. but presently best suggestion is that you should go ahead and take appearance and file your WS.

    You cannot file an additional divorce petition in kolkata as already a case is pending and you have taken appearance in the same. better is file your WS and let the case proceed further.

    According to section 19 of the Hindu Marriage Act, every petition under this Act shall be presented to the District Court within the local limits of whose ordinary original civil jurisdiction: (i) the marriage was solemnized, or (ii) the respondent, at the time of the presentation of the petition, resides, or (iii) the parties to the marriage last resided together, or (iv) the petitioner is residing at the time of the presentation of the petition, in a case where the respondent is at that time, residing outside the territories to which this Act extends, or has not been heard of as being alive for a period of seven years or more by those persons who would naturally have heard of him if he were alive. In view of the above legal provisions you cannot file divorce petition in Kolkata.
