Evacuee Land Allotment

My grandfather and his elder came to India a little while before independence. They worked odd jobs here and there and after independence, they were allotted evacuee land for agriculture. My grandfather's elder brother was clever and he got that allotment in his own name. And gave a meager piece of land to my grandfather to feed his children. My grandfather has 6 sons and his brother only had one. So, after he died the land was divided 50-50. Now, my grandfather is quite sick and I can't help but wonder, that technically the land belongs to my father's cousin. What if he goes to court against is. Will we have to give up our family land.
