Family Case

My husband is an nri working in USA earning very good salary and I got married 5yrs ago. I have an 1 yr old child. My husband under the influence of mother use to torture and harass me. He sent me to India with my child and never cared about us. Finally we had filed case 498a,420, attempt to kill and disowning the child. Now I will be filing domestic violence case. Could you pls suggest how long these cases usually take? im not working and having financial difficulties to raise my child. if interim maintenance is filed how long will it take for court to grant and what will be the amount? my child born in usa and what about my child custody?
