My sister is divorced from her 1st husband. And got married to the 2nd husband. And never went to his house. And filled case against him. However is not yet divorced from her 2nd husband. She used to stay with us in my father's house and fight with us every now n then and lodge a police complaint and court against us. There are already 2-2 criminal cases filed against both of us by her. Now we do not want to keep her in our house. She has filed a case in the session court and pledge for interim order to allow her to stay in the father house and assure her that we not harm her and shall not be removed without any court order. My father who is 80yrs heart patient also does not want her to stay in his house. As she often fights and beats him. He is ready to say it in court. He has also filled NC complaint against her in our local police station. And also my father has made a registered motorized gift deed 3 years ago of the house in our favor. We do not want her to enter the house anymore. Please advice very best easy and quick way to get rid of her. We belong to a middle-class family and do not have much to spend on the court case. We have not yet appointed any lawyer and if possible please advice best and affordable lawyer. This case is in Mumbai session court.

This is in further response to you: 1. Technically speaking she is married so she should be living with her husband; 2. But a daughter cannot be disallowed to enter her father's home; 3. Ask her husband to file RCR so that she goes back to him; 4. But if she creating nuisance then the police should evict her; 5. Now if your father makes a gift deed in your favour and the agreement is registered then you become the sole owner of the flat; 6. You being the sole owner can now remove your sister; 7. You can file a case of trespassing against her.
