It's not clear whether the property is given to JDA or a private developer. In all the cases when a person who granted the PA is dead then the PA is dejure nonest ie automatically canceled from the moment of demise. Then the property is legally reverted to the legal heirs as legal owners. If the property is in the possession of the other side immediately file a suit for recovery of possession and injunction against committing any waste in the local court. In any case a fresh agreement is needed if legal heirs wish to continue the arrangements. If dispute arise between the parties then only filing of the suit is required
After approaching the JDA, you can go for the following preliminary options: 1. A suit for recovery. 2. A suit for specific performance. 3. A suit for possession if the possession is not with you. 4. A suit for damages and recovery if some amount has been paid off. 5. A suit for positive Injunction. pls note: these are some preliminary steps, you can file more cases plus you'll have to pick a remedy and can't file all such cases.
