Sir, my car was hit by a amenity bus hired by my company on wrong side of road inside our township in which my family escaped narrowly 3 months back. Company HRD officer who is also the engineer incharge of contract for hiring amenity bus mediated with bus owner and written undertaking was given by supervisor of bus service on behalf of owner in a plain paper. As per undertaking, owner was to take full responsibility of repair of damaged car. According to it, he undertook to shift the vehicle to authorized service centre and to pay expanses towards repair of damaged car which is 16 years old. It was also agreed that whatever insurance claim will be materialized, the same will be deducted from the bill and differential amount will be paid by bus owner. But the owner did not do anything and now not agreeing to pay full amount for release of repaired car from service centre. After a lot of persuation, he offered to pay 50â„… of differential amount. l have asked the company to deduct the amount from his bill and give me. But, company say they can hold the money but cannot pay to me. I am not able to take delivery of repaired car since last one month. please advise what are the options for me. Can I go for legal actions and against whome? My state is Odisha
