    Phone tapping is illegal whereas recording a conversation is not illegal.. There's lot of difference in it.. and i already used such evidence even in supreme court.. verify this judgment https://indiankanoon.org/doc*Phone*/ Madras High Court A.R.Periyasamy vs G.Karunakaran on 1 December, 2008 google it.. where they discussed this issue..

    Without the consent of the other person, recording a phone conversation is illegal. So kindly before the conversation starts, say the person that your phone call recorder is on and then talk randomly for long, then they might forget about recording and at last just make them say wat you want to use as evidence.

    Yes, u can file suit for recovery of money or criminal case for cheating.. try to record a phone conversation in support of ur claim. and then start with a legal notice..

    You can issue a lawyer's notice seeking return of the amount you gave to him. If the lawyer's notice does not produce the desired result you can go to court and file a case for recovery of the amount. You may lodge an police complain for Cheating and Fraud. As the money is given by cheque the remittance can be proved in the court.
