1st Advertisement published on 25 June 2018 for Trained Graduate Science Teacher in the stream of chemistry botany zoology by district welfare section SC ST Development Department District Rayagada Odisha State. Same submitted before the court as an Annexure. Required post mentioned in advertisement of Trained Graduate Science Teacher in the stream of Chemistry Botany Zoology as mentioned below. Advertisement number 2117/2018 dated 25 June 2018. Unreserved Male - 5 Unreserved Women - 3 SEBC category - 1 SEBC category women - 1 ST - 3 ST women - 1 SC - 2 SC women - 1 Total post - 5+3+1+1+3+1+2+1 = 17 Out of 17 post unreserved is total 8 that means reservation exceeded 50%. Contrary to law. Then Provisional draft merit list of B.Sc B.Ed TGT CBZ stream published on 02 August 2019 vide letter number 2140/XI-23/2019 In provisional draft merit list as a general category applicant i was in the rank of 3 among the UR Male candidates only. As per instruction of above letter number 2140/XI-23/2019 of provisional draft merit list i complied the objection i.e non submission of resident certificate in time by post along with prescribed objection format. objection format , India post consignment receipt and article delivery status of India post enclosed herewith . same submitted before the court by the Annexure. Since the date of publication of first advertisement 25 June 2018 it was processing and delaying then on 13 November 2019 the final merit list for the post of B.Sc B.Ed CBZ stream was published vide letter number 3370/2019. same submitted before the court by the Annexure. In the final merit list ST and SEBC candidates having more career percentage than the petitioner are appointed in ear marked unreserved post. But they availed the reservation relaxation before final selection by qualifying with less than 60% mark in Odisha Secondary Teacher Eligibility Test (OSSTET) and qualifying age limit even their age exceeded 32 years as OBC category . They are the opposite parties mentioned in the order of court. Their OSSTET mark and Age mentioned clearly in the Provisional Draft Merit List. I exempted after their illegal selection in UR seat , Then i filed a petition at Odisha High Court vide case number WP(C)/22882/2019 Registration Date: 22-11-2019 . Kindly share with me if any referable judgment pertaining to ST SEBC can't be posted in UR seat if they availed any reservation relaxation before final selection like age relaxation, qualifying mark relaxation in competitive examination for the same post even they secured more marks than UR candidate . How can i win this case.
