    To obtain succession certificate, a petition to the District Judge within whose jurisdiction the deceased person ordinarily resided at the time of his or her death or, if at that time he or she had no fixed place of residence, the District Judge within whose jurisdiction any part of the property of the deceased may be found. Petition for Certificate A petition for succession certificate must contain the following particulars: Time of death of the deceased; Residence or details of properties of the deceased at the time of death within which Judge the jurisdiction falls under; Details of family or other near relatives; The rights of the petitioner; Absence of any impediment to the grant of a certificate; Grant of Certificate On making the petition, if the District Judge is satisfied as to the ground of making the petition, can grant an opportunity of hearing to persons who, in his/her opinion, should be heard. After hearing all parties, the Judge can decide the right of the petitioner to be granted the succession certificate. The Judge would then pass an order for grant of certificate specifying the debts and securities set forth in the application empowering the person to receive interest or dividend or to negotiate or transfer or do both. for obtaining succession certificate court publish publication in local newspaper for inviting objections if any within 30 days from the date of publication. Therefore it take near about 40 to 45 days for obtaining succession certificate.

    you need to file petition for grant of succession certificate before the concerned district court,. whereby u have to mention all the requisite movable or immovable properties of your father and also need to obtain noc from othwr legal heir, a court fee is also payable.

    A petition for grant of succession certicate is to be filed if no objection is given by other legal heirs it will granted early State is also to be made a party which will tell the value of assets ,as per value of claim court will order publication in a newspaper thereafter stamp duty of 3and half percent to be paid if it is in Delhi,other states demand stamp duty as per their laws thereafter an indemnity bond and surety bond will have to be submitted in court and u will get the succession certificate Correct the sentence "will be granted" if you satisfied my answer. give 5 rank and review thankyou

    There is no onlone system or process for obtaining a Succession Certificate. You have to apply and file a Petition for grant of Succession Certificate and then to prove your legalheirship in a set process. No specific time frame can be demarcated for the finalisation of the process.

    Dear Ankush There is no online platform till date to get succession certificate. To get succession certificate you have to file application in civil court of the concerned district of your place and after the same court will issue notice to all the concerned legal heir/persons giving them 45 days to oppose the same application. In addition to this, court will get publish the same in daily newspapers. If they don't oppose then court will issue an order in your favour and grant certificate of succession. This will take 2-3 months. You have to pay court fees along with your application, which is 2-3 percent of the assest/property. For seeking further details kindly contact me.

  • As such there is no online process for issuance of succession certificate. You shall be required to file a proper petition in court detailing all assets of father and details of all legal heirs for obtaining succession. After filing notice shall be issued to all legal heirs. If there is any objection from any corner then the same shall also be heard by court and objector can file its objection. A public notice shall also be published in two news paper, thereafter evidence be recorded and simultaneously report from authorities like bank etc be also called. The stamp duty in accordance with the value of assets shall also be payable.Final order is passed.
