After Divorce Money Compensation For My Aunt | Vkeel - Free Legal Advice

My aunt's husband has left her. She is 62 years old. There is a lawyer in the family who took her case to court for free. The court ordered the monthly compensation to be paid to her. But what happens is the money comes from her husband's side through a lawyer every month and not directly to her bank account. And since the last 3 months, she didn't get any compensation. Her husband is a state government teacher in Bihar. My question is, is it possible for her to get money directly to her account at the time her ex-husband gets a salary from the government. Not the way where her ex-husband is sending manually as he will again stop sending the money and every time going to the court she cannot do because of her age. Please help me with advice.

Dear Arqam You can file petition under procedural laws provisions for seeking proper execution of maintenance order to the concerned court. Court has power to issue arrest warrant against the defaulter and recover money out of his personal properties. You can seek direct credit of maintenance money in her personal bank account. Better file a miscellaneous application in the same court and seeking a direction to the drawing officer/employer to deduct such maintenance amount from his salary and credited to her account.
