Try for convincing her to get Divorce on mutual consent upon money in lumsum as Alimony. If she refuses to sign Mutual Consent Divorce, please file contested Divorce against her in Family Court on grounds of Cruelty and Desertion. Engage local lawyer for the same. As far as the D.V. Act case against yourself is concerned , contest it on merits. If relationship becomes more and more bitter, as the time of separation in increases, then be prepared to face Criminal Complaint and CrPc 125 as well. alimony can be given only in consent divorce which means both of you agree for the divorce if not the court will only order for maintenance to the wife which she is entitled to get based on her economic state of living
