    You may file Sec9 Restitution of Conjugal Rights petition if u wish to continue the Marital relationship.. However if u wanna file divorce u should wait for 2 years of separation on the ground of Voluntary Desertion. Its better to substantiate by evidence that u took bonafide attempt for reunion. in case of divorce been granted u may be held payable for maintenance of ur son and not for her.. Quantum will be decided after appreciating the income of both side.You and ur parents can seek for visitation rights which u can file at any time.. after age of 6 u may seek the custody of him.. for further assistance plz book for consultation..

    Hello, Nithish, IF your wife is not interested to join you in the matrimonial house you could file a petition to nullify your marriage which means divorce. It is nice you have taken the decision to stand by your age old parents who very much require your company warmth at their middle age, as far as the matter of maintenance is concerned you need not give much because as she is also an working woman only thing is that you need to pay for the maintenance of your child which could also be less as your wife is also working.
