Me (23F) and my sister (18F) has been witnessing domestic violence in our home in the form of physical abuse by our father since we were kids. I want to seek divorce help for my mother. I have a few questions. I am studying at a university and I have no income source. My sister is in her 12th and also doesn't have any source of income. My mother is a working woman but her earnings aren't enough to support our education. If they get divorced, what is our alternative apart from relying on my father's money (which he will not give if there is a divorce)? My house is a property of my father, can my mother have a claim on the property. How much do we have to pay the lawyer for a divorce case? How will my mother's protection be ensured when we leave the town for our studies. It is an unbearable environment for us to live in, both I and my sister have been in this trauma phase for a long time, and are having mental health issues. Please help.

Ms. Debaleena First, Consult your mother whether she wants to seek divorce from your father. If she wants to go litigation then she has legal right to file complaint under domestic violence act provisions and seek compensation, maintenance from your father. In addition to this petition for divorce can also be filed. Your mother has equal right to reside at your father property. If your father is continuously turtorturing your mother then she can seek residence and protection order in order to protect herself.
