I'm a Hindu Girl, I was in love with a Muslim guy, a few years back I got married to him, he promised me verbally that if things don't work out initially we will divorce, but he refused, since the day of the wedding till date we haven't lived together at all, there has never been any physical relationship between us till date, we have met only 4-5 Times in these years that too in public places and for 10-15 mins only, we fought a lot on the phone, but he is not willing to grant me a divorce, we both even don't have a marriage certificate, only one page nikahnama and one stamp page, ( There is no marriage certificate, is this marriage valid .), both these pages have my thumb impression only, he isn't showing me papers also he traces my calls and sms also, he has physically beaten me also twice, I have a medical report of that, my family is not aware of this marriage and I don't want them to know anything about this, I want to get separated from his asap, What should I do. Please help

You have multiple options in the matter but on priority basis You should take assistance from the Police, your marriage is also.not valid.

Nikahnama is not valid because you are Hindu and He is a Muslim .You both should have married under special Marriage act. File criminal Complaint against him take assistance of any Advocate in this Forum for your relief.

On many grounds you can file divorce but registration if marriage is not compulsory.

You are asking for legal help, many options are available to you, but before moving ahead with your query, I would like to ask will you take any step (harsh) since your parents are not aware of your marriage instead nikah with the Muslim guy. I suggest you take your parents in confidence and consult me or any other lawyer of your choice to take a legal step against the said person who is ruining your life.

This is not valid marriage. Rather by force getting any thumb impressions doesn't make any contract valid. So you can file a writ Petition CRIMINAL in the High Court for police protection incase he invades your privacy. Book Consultation for further help.
