    I my opinion that u may file a complaint case or lodge FIR, if you have got enough evidences of solemnisation of the second marriage and u may file a matrimonial suit for a decree of nullity of the second marriage or you may file a suit for divorce on the ground of cruelty. choice is yours. But in my professional experience, to prove a bigamy is most difficult

    Section 494 of the Indian Penal Code. The law states that, whoever in the lifetime of existing husband/wife marries someone else, such marriage by reason of its taking place during the lifetime of such husband or wife, should be considered void and should be punished for such offence. If any person marries more than once during the life of first husband or wife should be punished with imprisonment which may extend to seven years, and shall also be liable to fine.     hi as per Indian laws second marriage while first spouse living is void ab initio. the marriage cannot be said to be legal and second wife does not possess any matrimonial status moreover first wife can sue you for bigamy which is an offense therefore it is advisable to get divorced first and then proceed to marry second wife
