My wife had arguments for every small thing. From the last 2 years. We have a child and we both are earning equally. Please let me know if I file a divorce case what is the next step and do I need to pay any maintenance to her after divorce. We both had love marriage. I didn't get any money from their side. Including marriage expenses. Every time, she asks for divorce for every small thing. And she sent me out from her house. And the house is with her name. For every small reason, she says get out of my house. Three time it happened from last year's. Now she is saying that she won't give any divorce and she can't stay with me.

I agree with advice of Advocate J L Naagar . But you will have to pay Maintenance towards your Child only. As your Wife is qualified and already learning she cannot claim Any Maintenance.

Cruelty probably could be the ground for the divorce which you can take alongwith the others grounds available for Divorce. You can go for divorce. Yes, you may not be burdened with heavy Maintenance but you may be saddled with litigation expenses and maintenance for the child may also be burdened upon you.
