My wife has been living separately for last 2 years, she always asks me to separate from my parents. (total marrige time 5 years.) i want to know if i file section 9 rcr, on her (as i genuinely wants to bring her back. ) but if it goes too long and she files false charges on me can i withdraw rcr and file divorce against her on the bases of already said 2 years desertion and cruelty. will withdrawing rcr will make my divorce case week in that event... does withdrawing rcr means i accept all her charges, and also i lose all charges/grounds from my side till date...

Dear Sir, You may opt for divorce on the ground of cruelty and desertion for more than two years.

it depends on the circumstances of your case. sec 9 HMA is the case of Restitution of conjugal Rights and Section 13 HMA deals with divorce petition.
