Yes.. U can claim. And u can take share. U claim for maintenance by side of your son
Wife has no share except huge alimony. Further son has a share if it is ancestral property that is coming from last four generations. Discuss. Please give me Rank 5 and Review my Resume and Follow me if my answer satisfies you
Wife and children cannot get share in husband's/father's share during his life time. If he passes away intestate i.e., without bequeathing / dealing with the property in any manner, under such circumstances (if you are Hindu) you and your children will be entitled to equal share. During his life time, you will not get any share.
Yours is case which requires more clarification about facts. You can ask for the share if it not a self acquired property. But you are at liberty to claim all your rights available to you under other Women Laws for attaining relief. Follow me and contact me after reviewing my resume, if further discussion or explanation is required.
Dear Madam, Be clear that in the self acquired properties the son has no share and you have a right to claim alimony as follows. However you can file multiple cases which bring pressure on him to settle and give a share.
you can seek for maintenance and you can also claim the share in his property and you can also claim rented accomodation from your husband. Eventually, you can file for divorce under hma and seek full time alimony and interim maintenance
in the ancestral property your son can claim his share you can file a suit for maintenance
