    you cannot get that flat from your husband practically not possible by approaching the court but you have option file a divorce case and maintenance case your husband will come for amicable settlement then you demand the flat. only this way you succeed other civil proceedings are immense and time waste. for further assistance kindly book for consultation.

  • Since the property has been bought under the husband's name he has the full authority to do whatever he want to do with it. He can name it to anyone. Unfortunately, You or your child do not have any right on the property. Restraining him from selling the property off would be a hard sale in the court. If you have monetarily contributed(even one payment of loan from your account or by you) into the property then he has to ask for your permission and consent to before selling or transferring the property to anyone.     Since it booked earlier to marriage, technically your rights is not absolute unless u approach the court.. However u r not remedy less.. Infact you have equal rights if the repayment is paid by your husband subsisting marriage.. you may need to take plea of your personal contribution i.e. Jewel pledge or Salary (if u r working).. Since they are in possession and ur husband not cooperating u, you have no other option than to approach court and get injunction. if it's practically not possible, you (or ur side family) should somehow get the possession of the flat.. otherwise anything might happen for further assistance plz book for consultation..
