First fact which you need to check is whether you have got your marriage registered under Hindu Marriage Act, 1955. Certificate issued by Arya Samaj may not be considered as valid proof of marriage in eye of law by the court. However, plz issue notice for restitution of conjugal rights at threshold and thereafter, initiate proceedings under section 9 of Hindu Marriage Act.

Your oral statement coupled with Arya Samaj evidence is enough. File petition under section 9 of HMA Act and get your wife back. Please give me Rank 5 and Review my Resume and Follow me if my answer satisfies you

  • Sir, your marriage is absolutely legal. Moreover, simply by burning the certificates the marriage could not be annulled as there is a registration number and the records are stored. You can knock the doors of the court for Restitution of conjugal rights u/s 9 and there are other pressure tactics as well which can be used in this matter. Book a consultation and give me 5 rating if i was able to help you with your query.
