    Your marriage was definately legal and now you want sepration then your can file a petition for dissolution of marriage and contest it or you can amicably settle disputes with your wife then both of you can file mutual consent divorce to get seprated peacefully. kindly give 5 rating to my opinion and consult me for best advice.

    don't forget to draft an MOU before approaching Mutual Divorce, which is the most essential and important part of a Divorce case, some basic points to keep in mind and put in writing through an MOU before filing the petition for mutual consent divorce are custody of kids, distribution of assets (movable/immovable), quash/withdraw of pending litigation if any, Maintenance (present/future), Alimony, mode and time of making the payment, streedhan, future litigation, etc.

Your marriage is Legal, 2. if you do not want to continue the relationship, then, try to settle the matter amicably with your wife involving elders/relatives/friends etc and go for Mutual Consent Divorce which will be decided in 6-18 months, and you both will be free to live life with your wish,

    Now, the Supreme Court recognized live in relationship as marriage and given that girl the status of WIFE. It is legal marriage. Go for mutual divorce or contest divorce.

    Dear Himanshu, as per section 13 of Hindu Marriage Act, your marriage is a valid marriage, dont worry about it. if you want divorce/seperation there are certain grounds and onditions on which you get it for contested divorce or you both spouse can apply for mutaul divorce, if you both agrees on the same terms. if you need any further help you can book phone/email consultation.

    If the marriage was as per Hindu rites and of both of you are Hindus. Then marriage is legal. you can file appropriate proceedings for separation

  • If the Arya Samaj Mandir issues a false certificate then an application can be filed in a civil court to nullify it's effect and in case all the photographs, videos etc available and at the time of marriage it was authorized then only wayout is divorce.     If the marriage is done as per Hindu Customs and Rites then it is a legal marriage, in presence of some witnesses, even though the mandir is not authorised to issue certificate of marriage, which is required for regn.of marriage, for a limited purpose. Nowadays even live-in relationship as husband-wife is also recognised.
