I had purchased a flat and paid stamp duty, registration. The society secretary is not ready to transfer the share certificates on my name as he says that the seller has not paid the stamp duty when he had bought from the first owner. Is the secretary right in not transferring the share certificate on my name? Am I liable to make the payment for stamp duty which was not paid by the seller?

Hi, Since you have already paid the stamp duty during the formation of the agreement therefore you cannot be forced to pay stamp duty again. Also you are not responsible for the duty of another person. Thank you. Do feel free to contact in case you need further assistance.
