Hello, I had booked a package tour from makemytrip with no reschedule or cancellation policy as per their company policy. However due to an unforeseen emergency, we had to reschedule the dates. We did not want to cancel, just wanted the travel agent to help us reschedule since the booking amount was paid in full amounting to 1.4 lakh. My query is: 1. While the company policy says no rescheduling cancellation, is there any consumer protection rights available under these scenario? Why should a travel agent, whose job is to liaise with providers, cannot at least refund with penalties. 2. Since I am cancelling a service under emergency that was already paid for but not availed, incurring necessary penalties, why should not the travel agent at least return the amount to source account rather than locking it with themselves.

Dear client I am sorry to hear that but in this case you can go ahead and issue them a notice for recovery of money ever if he does not reply to your notice then you can go ahead and file a money recovery Suit against him in the court

1. Issue them notice through lawyer demanding your money and if they refused to pay then File Money RECOVERY SUIT IN COURT through lawyer. 2. Issue them notice through lawyer and File Complain in Consumer Court and claim heavy compensation for all kinds of harrassment and torture.

First of all rather than going legally you should serve them a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.
