Hi Chaitanya, So there are 2 things: Firstly if the spouse has deserted for a continuous period of 2 years it will serve as a ground for divorce Secondly, as in your case, i.e. mutual divorce, you can file it after 1 year of marriage and then between first motion and 2 nd motion there is a waiting period of 6 months. Hello, Mr. Chaithnya, the suit for divorce can be filled at any time after desertion and get the decree of divorce.
one year is sufficient to contest the case, on the ground of desertion.
divorce is granted after six month from the date of petition.
