Asked in Civil
Prosecutor is a lawyer. A lawyer is anyone who graduated in law. Advocate is the practicing lawyer (enrolled in bar council). All advocates are lawyers but not all lawyers are advocates. Prosecutor is an advocate (as well as a lawyer). Even Prosecutor may concurrently appear in Civil cases unless there is a service condition to delist in bar council.
It is debatable subject. To my knowledge if such prosecutor is a permanent employee of State Government then he can be called as prosecutor only and his name on the rolls of Bar Council has to be suspended. It is because when a lawyer become judge on permanent basis his name will be kept under suspension and cannot practice independently similarly a prosecutor cannot practice independently.
