Non Creamy Layer Eligibility Of A Person With Guardian

My Father was a Farmer and was having income less than 2 lakh per annum. I have lost both my parents at my early age. I belong to OBC caste. I have been with relatives who are my Guardians since then. What are the criteria for Non-Creamy Layer if both the parents are not alive. If I want to apply for OBC(Non-Creamy Layer) Certificate, will the Annual income of my guardians be considered? Am I eligible for Non-Creamy Layer since it should be calculated based on Parent's income only?
