How to prove a notray agreement is backdated? My estrangedhusband is using a notary agreement to show he took responsibility of paying his parents loan of 1cr without any consideration. The agreement is notraised and not on stamp paper? it is primarily done to reduce his net worth to not give child maintainenance and alimony in Europe. is this agreement valid and legally enforceable? Also, the notary agreement is back dated - how can i prove this? The notary agreement was done in UP

If the agreement is without consideration (₹1 crore loan repayment without any reciprocal promise), it may be hit by Section 25 of the Indian Contract Act, 1872, making it void unless it falls under an exception (like natural love and affection, or past voluntary service). Even if notarized, courts may not treat it as binding if it was executed to defraud legal obligations (like reducing liability for maintenance/alimony).
