Accused Undiscovered In FR,and Complaint Puts Protest Petition Against That FR

The magistrate record statement of complainant and his witnesses, and if satisfied issue summons to the accused named by the complainant or else he may dismiss the claim of complainant and accept the Police Report and close the case.

if (1) again the police will investigate and may/may not file charge sheet.. if chargesheeted then PP & Police will prosecute and complainant will come as a Prosecution side witness.. if (2) then police role is dropped and Complainant will conduct Prosecution with his lawyer and accused should defend..
