file a P.L. u/s 226 of Indian constitution before Bombay High Court.
file a complain to police for threatened and abusing also. law limits.
First of all you try to bring out these issues before the public through the fourth estate by a press conference. Give a detailed complaint to the Commissioner of Police, Mumbai and release that through the press conference. Then file a public interest Writ Petition before the High Court. Rest things will take care of itself.
article 32 & 226 of Indian constitution are guradian for protecting our fundamental rights from infringement or violation. Article 32 is for Supreme Court. Article 226 is for High Courts
Public Interest Litigation is meant for enforcement of fundamental and other legal rights of the people who are poor, weak, ignorant of legal redressal system or otherwise in a disadvantageous position, due to their social or economic background. Such litigation can be initiated only for redressal of a public injury, enforcement of a public duty or vindicating interest of public nature. It is necessary that the petition is not filed for personal gain or private motive or for other extraneous consideration and is filed bona fide in public interest. There are three basic requirement to file the public interest litigation. They are:- 1. Personal Injury 2. Causation 3. Redressability 1. Injury: - The plaintiff must have suffered or imminently will suffer injury- an invasion of a legally protected interest that is concrete and particularized. The injury must be actual or imminent, distinct and palpable, not abstract. This injury could be economic as well as non-economic. 2. Causation: - There must be a casual connection between the injury and the conduct complained of, so that injury is fairly traceable to the challenged action of the defendant and not the result of the independent action of some third party who is not before the court. 3. Redressability: - It must be likely, as opposed to merely speculative, that a favorable court decision will redress the injury. Prudential Limitations of Locus Standi:- Additionally there are three major prudential limitations or judicially created standing principles.Â
according to me this is easy way to get justice.... otherwise wait for others response or you can approach to local advocate in Bombay High Court.
