Dear Sir, Seeking a Direction to File the Charge Sheet If the investigation is dragging on indefinitely, the primary remedy is to approach the High Court to ensure the process moves forward. Writ of Mandamus: You can file a petition under Article 226 of the Constitution asking the High Court to issue a "Writ of Mandamus." This directs the police/investigating agency to complete the investigation and submit the final report (Charge Sheet or Closure Report) within a specific timeframe. Section 482 of the CrPC (or Section 528 of BNSS): The High Court has inherent powers to prevent the abuse of the process of any court. A petition can be filed here to seek a direction for the timely conclusion of the investigation. 2. Seeking Quashing of the Proceedings If the evidence (the vague suicide note and the verified alibi) suggests that no prima facie case is made out, you can move to have the FIR (First Information Report) cancelled entirely. Petition for Quashing (Section 482 CrPC): You can pray to the High Court to quash the FIR. The court will look at whether the allegations, even if taken at face value, constitute an offense. Since the alibi is undisputed and the note doesn't mention "instigation" (Abetment under Section 306 IPC), there may be strong grounds for quashing.
