    Dear Sir, Until and unless you satisfy the Judge with your documents is not supposed to issue summons to the Accused. Every civil case that is recovery of money cannot be called as criminal case. You may parallel to the criminal case file a civil recovery suit claiming principal amount and interest. If the Defendant does not appear you will get ex-parte judgment.
