IPC though not applicable to JK, a similar law without any changes is made for the state. Thus the offense is cognizable.

Section 309 of Indian Penal Code lays down the consequence of attempted suicide. In case he/she fails to die, the maximum punishment that can be awarded to him/her is simple imprisonment for one year,or fine or both. However, IPC does not extend to J&K. The reason behind this punishment is that life is considered to be a state property, not someone's private property and whoever tries to take it is punishable by law. This Section (309 IPC) is purely Constitutional.
