Industrial Dispute Act Case, Workmen Vs Management, Illegally Terminated

I filed complaint in Asstt. Labour Commissioner for illegal termination of workmen by management and thereafter Conciliation Proceeding was instituted but failed and the matter was referred to Labour Court to decide 2 issues:1.Was the workman illegally terminated. 2. If so, is the workman entitled to reinstatement with back wages. The case has been running for 3 months in the Labour Court, The Management did the cross examination of workman and next date is fixed for cross of management by the workmen's lawyer. In the Statement of Claims, the facts are there but there is no prayer for reinstatement with back wages. Is the suit maintainable. Is it mandatory to have prayer even in referred matters of Industrial Dispute. Can the Court dismiss the case at this stage.
