My sister filed 498 A case in 2015 in junior civil court. Court advised police to look into that case. They took the case in 2017 and my brother in law got stay in high court last year july. Now it is almost 1 year 4 months. Recently, supreme Court gave judgment that all pending stay cases in high courts automatically gets cancelled after completion of six months from judgement date. Now my brother in law stay crossed 6 months and still the case status showing as pending. What should we do now, is that stay cancelled or we should approach high court to cancel that case and receive the copy from high court?

As per Asian Surfacing judgment yes you should annexe that judgment while file Stay Vacation Application

Complainant can also file vacate stay.. besides by virtue of that SC order unless stay is extended again by Accused stay automatically gets over.. need not file petition.
