Loss From Stock Tips

I had paid Rs. 5000 online to stock market tip provider. This money was the advance towards the 20% profit sharing. I was not profited by the tips provided by the person. He is not a SEBI registered person. he stopped giving the tips after one month. In the beginning, he did not inform about this. I was not profited by his tips. He said that the money will be treated as advance till my 20% amount exceeds Rs. 5000. It means only after I got Rs. 25000 of profit I will start paying 20% of the profit in excess of RS. 25000. There was no condition of a month, as it was not a monthly subscription. What legal action can be taken to recover my money. I know his mobile and not the address.
