Money Given By Bank Transfer But Accused Not Paying Me Back

I filed a case for recovery of Rs12 lakhs and the accused claimed that he paid Rs10 lakhs in cash to me .The accused is himself accepting that he received money and acknowledging that he paid in cash. Still the judge wants agreement of money given and accused false claim of giving me miney in cash is not recognised by judge as fraud and cheating case .How to handle the case now?
