new DV case (PWDVA) first hearing on Friday - but summons not received by the respondent party yet, The respondent party advocate learns about the case# from the court cause list of friday.. Should we plan to attend first hearing on Friday or wait till summons is received ? Could there be exparte order possible in DV in first hearing itself "even if the first summons not received by the party ?

if your prayer in the case is for interim maintenance or maintenance as such, the maintenance can be ordered ex parte also. there is no need for summoning, however, different high Courts have a different view regarding this. contact for further details. regards

Summons will be again send by court and through try to get it delivered through Five ways.Consult and adv. and if possible hire an Advocate as a Complainant lawyer.You will get legal benefit of it.
