If it is a criminal case then an applicant against whom a criminal case is pending, is required to obtain necessary permission from the Criminal Court wherein his case is pending and then make an application to the passport authority.

you can move an application to the court for releasing the passport on the basis of reasonable ground.

if ur passport retained by Court than Court has power to release it or you did not have passport than apply in passport office.

you have to file an application for getting back your passport or otherwise wait until completion of case
