However the best way for this country wide problem is to file complaint under RERA act.. The Real Estate (Regulation and Development) Act, 2016. You'll get damage or reimbursement with interest etc.. Note : it is a new law, so only very few lawyers have knowledge over the same. Find one.. More over some states not yet notified the regulatory & Appellate authority..
You can file police case, but technically not maintainable.. however he may come for settlement.. besides u can file Consumer case too, but normally builder invokes a saving clause in the terms of agreement to escape from same. He claims immunity that the default is on the part of govt authority delay..

If paid money then developer is liable u/S 420 IPC. liable also for breach of contract, if u have any writing regarding this contract. File criminal complaint against developer. If developer is commity society trust etc then liability under consumer laws is there
