In my case a person given a cheque for Rs.1 Lac bearing his signature. this cheque returned unpaid with insufficient funds remarks. we have sued him under section 138. accused filed fir in separate court that sign on cheque and account is not opened by him so direct the police to send this cheque to fsl. He also said that account is not opened by him this is opened by me. police sent this cheque & a/c opening form opened bearing sign done in 1987 (when his age was 18 years) with completely changed signatures done in 2006( when his age was 37 years) for fsl. After some years of opening of account he changed his signature completely, the signatures taken in 2006 by police sent to FSL, was completely different than on cheque. so fsl reported that author of the cheque and author of the signatures done in 2006 are different. During his cross Accuse admitted he has one more account in same bank with same signature as done on cheque and he admitted that this account of his own but he didn't disclosed it to police for FSL. We prayed to court to compare the signatures of disputed a/c opening form and cheque with admitted account opening form by FSL but court declined our application. Case is at the stage of evidence. Cheque was in court's possession. when we prayed to court for FSL, Court told, you should pray at the time of your defense.
