Dear Sir, You can file application in the same suit under Order 7 Rule 11 of Civil Procedure Code to return the plaint as it is without cause of action.

You could have file an application under O 7 R 11 CPC for rejection of the plaint before filing w/s; (There is no point or sense in proceeding with the trial of the case, in case the plaint is only to be rejected at the threshold.) Now the following stages are: Replication by plaintiff Amendment of Pleadings (at any stage before final hearing) Filing of other documents Framing of issues List of witness Final Hearing If the matter is getting delayed by the plaintiff you can file a petition to expedite the proceeding.

This is my response to you: 1. Once you have filed WS then that will be considered for dismissal of the plaint; 2. Before WS you could have file an application for 'Dismissal of Plaint' under Order 7 Rule 11 of CPC; 3. If there is not merit in the matter the court may expedite and dismiss it.
