Asked in Divorce
As I already told you, the best option before you is to file a divorce case by mutual consent under section 13 B of the Hindu Marriage Act. However, as regards terms and conditions for the divorce, you may also put a condition in the agreement that your father in law will not try to insult your father by calling panchayat. You can put such condition in terms.. but it has no binding force.. not executable.. besides irrespective of whether there is an agreement or not, no one can compel u to attend any panchayat, u can call the cops.. and u can file Defamation suit if ur father in law indulge in any insulting things..
You and your husband may file divorce petition in court on mutual consent u/s 13 B of the Hindu Marriage Act*Phone*There are certain terms and conditions for the divorce on mutual consent. No body can compel you or your father to appear before Panchayat.
FATHER....FATHER.....FATHER.... first of all you should think like prudential woman. one can not insult it father in any way and you are need not obey any secret agreement in this regard.. if you sign on those terms, you should be paid heavily. if you incorporate any condition in that agreement, will not be bonded. who cares it? if ur father in law (seems like a cruel minded person) breaches your conditions , then what can you do? if your father in law wants to degrade the reputation in future, your papers can not obstructs him. Hence my suggestion is that you don't execute any agreement of non filing cases against it in laws in future. There is no need and save ur interests. settle the matter by approaching a Lawyer to obtain divers by mutual consent. unless an official divorce from court, your problem will not be cleared.
The marriage cannot be dissolved on the private agreement between the parties. It can be dissolved through court of law, either by filing an application of mutual consent to divorce or separate divorce application. In case both of you are willing to file a divorce petition on mutual consent, you can mention in the affidavit that both of you and your family members should not file a case against each other in future regarding the said issue. The said averment in the mutual consent to divorce petition is fair enough to avoid any future claim against each other.
madam in the divorce petition only you can mention that the husband and his family members will not interfere in your life and also see that before presenting the divorce petition in court your father in law is also present and he too will accept that he will not do anything which will affect you or your family.
